Cuthbertson: Public Hearing Not Needed Before Code Amendment Vote

Votes no to hear public comment next month regarding possible bamboo regulation; says his mind is already made up.

On at least one issue, the people's voice means nothing to Huntington Town Councilman .

When voting on whether to schedule a public hearing next month to a Town Code amendment regarding property maintenance nuisances, specifically a proposal to regulate the excessive growth of bamboo, Cuthbertson said his mind is already made up. 

"I have concerns with the motion that we are going to regulate the bamboo," said Cuthbertson, at a meeting at Monday. "I don't know what would be next, poison ivy?" 

Governement regulation works in some cases, but not with bamboo regulation in Huntington, according to Cuthbertson.

"I just think this trying to regulate the growth of bamboo is not the place where Town Board members should go," said Cuthbertson.

Town Councilman Eugene Cook reminded Cuthbertson that Monday's vote was simply to give residents a chance to voice opinion on the bamboo issue before a final vote is taken.

"This is to schedule a public hearing not to decide on the bamboo," said Cook.

Cuthbertson said he's already decided.

"I just want to be very clear that I don't support regulating it at the end of the day," said Cuthbertson.

"Isn't it our job to listen to everyone and hear what they have to say?" said Cook. "I think it's very important."

"The fact is councilman, there are some decisions that I can make right away and I know that I am not going to vote to regulate bamboo," said Cuthbertson. 

"Fair enough," said Cook.

By a 4-1 vote, a March 13 public Town Hall hearing on possible bamboo regulation was approved Monday.

The point is that he is an elected official, meaning he is supposed to represent his constituency. Yet, he doesn't care to hear what his constituency has to say. He is an arrogant and selfish man. Get him out!

I have seen areas where bamboo grows and it does look horrible and it is very invasive, so I can understand their frustration. But I would really like to see the town concentrate on cleaning up this town. Enforcing people to clean up their yards and their 8 ft into the street kept clean. Keep the parks clean, go after store owners that do not cleanup the front of their stores. Have the store owners keep an eye on loitters, if you are not buying something and you are just hanging out, especially the day laborers, it is called loitering. Shopping centers to make sure it's kept cleaned. How about the train station North side and especially the South side where it is always filled with garbage. The Southside is a terrible mess, parking lot needs to be repaved, new stall lines, free of debris, replace the trees that over the years have been taken down and not replaced. Replace the old fence along the Southside. This is town property which needs to be kept cleaned because how can they enforce the codes if they are breaking the laws that they implemented.

I would like to invite Mr Cuthbertson over to our house to se and learn about the impact the bamboo our neighbor has planted has on our property. Get the facts Mr Cuthbertson. Get out there and SEE AND SPEAK to those of us who must deal with this invasive plant!

First of all, people like Free2Be and Brock need to do a little research. Bamboo is NASTY and will absolutely destroy things, so this is definitely an important issue. Obviously someone needs to educate Mr. Cutherberson on this. No big deal, he probably had never heard of the issue before and like Free and Brock he doesn't understand how awful it is. It DOES sound silly and frivolous if you never heard of it before.
Second of all, it still passed 4-1 and will be heard so everyone learn to read please. I find it funny that important fact was slipped in at the end. It's like reading Newsday when they want to make someone look foolish. Listen, you can't be an expert on everything, so someone send Cuthbertson some info he can read and I'm sure he will see the light or at least acknowledge the importance/seriousness of the situation.

Whats next stop people from planting oak trees? they could undermine my driveay/retaining wall or the sidewalk.
I agree Banboo sucks - it grows everywere - a former neighbor had it. I went over and talked to them and we came up with a solution - may i suggest you do the same. Otherwise if this does become a code enforcement issue- i will send in my application to the TOH to be the official Bamboo inspector for the town - sounds like cushy gig

Free2Be & Brock are stating that there are major concerns in the town. Within the past week alone, there was a murder (where they have yet to find to murderer) and a church robbery which enlisted search dogs and a helicopter. So maybe bamboo is a major concern in your area - and that's fine - but please understand the frustration some of us feel that neither of these two crimes were mentioned at the board meeting this week.

The Town of Smithtown felt it was necessary to regulate this plant. Does that make them stupid? I'd say not. Also I think our PAID Town Board should be able to multitask like the rest of us!

Concerned Citizen, there's nothing to stop anyone from having the same name. We have lot of Jims, Marys and Mikes posting on Patch sites. Alternatively, you could use a real name, which would lessen the chance of duplication.

Trish, Free2Be and Brock, there is a 10:00am community meeting at the 2nd Precinct on Feb. 16th, and on Feb. 14th there will be a meeting at 10:00am at either Stimson or Walt Whitman which will focus on gangs and gang activity. I will be at both, and I hope you all will attend too.

In regards to this subject at hand, I understand how bamboo can be an annoying problem. So can termites, rats, train whistles, poison ivy, mean people, those who wear white after Labor Day, the Patch allowing more than one blogger with the same name, Tom Brady's girlfriend, all of the stores closing in Huntington, pot holes, etc... I object to implementing a LAW or debating a LAW to fix every problem. We have enough codes in Huntington, we do not need another. Heck, we can't even enforce half of the codes as it relates to some of the "apartments" in the area. I do not need to visit some of your homes to understand that bamboo is a quality of life issue for some of you... this is not the reason to impose more laws. The same person who wants the law will complain when they cannot get a permit for a new porch because they have bamboo, the same people will complain when they cannot sell there home because of non-conforming foliage, and all of us will be taxed more to implement bamboo inspectors and to hire people to remove bamboo from public land.

Free 2B Me, The Brock-Obviously you have never been subjected to the
destruction of uncontrolled bamboo. Agreed there are many other issues to be worked on. I believe the SCPD earns alot to deal with the shootings. As for paying huge taxes, I believe we deserve to have use of our backyards without paying for bulldozers because the neighbor decided to not put in the barriers. Its unfortunate we are at that point in society. Its unfortunate we need to make laws for people to respect their neighbors. Society is changing and respect for each other or lack of, is forcing these codes to be dealt with. I agree it's unfortunate but for alot of us, it is necessary as there are no other options. If it doesn't effect you be grateful.

Margaret - I would love to attend, but I work full time and will not be able to make a 10am meeting. I wonder why they chose 10am for both meetings as an evening time would be best considering Huntington is a working-class town.

No one is saying bamboo isn't an issue for some residents! However, we ARE pointing out that with murders & robberies, which have occurred just in the past 10 days, MAYBE there are far more pressing issues at this exact moment. Jane, if the violence in Huntington doesn't affect you be grateful.

Good grief, folks.
Do you think that government should only operate on the basis of serial processing, instead of parallel processing? Yes, there are vital issues of health and safety, but the town can wok on those AND protect the property interests of residents of Huntington. Cutherbertson is simply being his obnoxious self. As they say, a leopard can never change its sports.

there's the rub. AND. As they are not. People are dying and they are concerned about scheduling or not scheduling public commentary for a plant.

10am meetings do pose a problem. I took a day off from work in Dec. to attend one of the community precinct morning meetings (something some people might consider doing if they are able too), but if you do want to attend one, there is going to be a 7:00 pm community meeting at the 2nd precinct on April 13th.
As for the bamboo issue, I wish those of us who are dealing with this invasive "grass", yes, bamboo is indeed classified as a grass, could meet and share ideas of ways in which to deal with and eradicate it.

I am grateful trish that the violence isn't my issue, and I believe that the town and the scpd can and should both deal with it. And I am sorry for you having that be yours to deal with. But as this hearing is set we have to get the help when we can. Bamboo has become much more of a problem than anyone who does not have it near them realizes. Margaret-as for the bamboo issue, all those who are dealing with the problems of this invasive and destructive plant need to go to the meeting on March 13th and support Ms Berland. Maybe, possibly Mr. Cuthbertson might actually listen to what the people have to say. It would be great if he saw alot of people come to speak and even listened. At least there are other board members who can also listen. And possibly follow ALL the other towns that have set regulations to keep those who want it responsible.

I'm amazed by the sheer myopia and selfishness of some posters.
They seem to think "it isn't my problem, and besides my problem(s) is(are) more important, so who cares." Government can deal with more than one issue at a time, and it should deal with more than one issue at a time. I won't accept less. For some of you folks, the concept of perfect -- the satisfaction of one issue to the exclusion of others -- has become the enemy of the good. This is a matter of arrogance, on the part of one out of five members of the Town Board. It's no more complicated than that.

My thoughts were simply related to dealing with too much regulation.
Anyway, the problem is not that we have too much bamboo, the problem is that we have too few pandas. I'm outa here.

Please those who do have Bamboo problems. THIS IS YOUR CHANCE TO SPEAK. Come to the meeting on March 13th and support Ms. Berland. It may be the only chance we have. Lets follow the lead of all the other towns. We deserve to use our highly taxed back yards without having to bulldoze them first.

Good post. The rest don't seem to get it. BTW I don't have a bamboo problem. I just happened to do some reading on it - it's a nightmare. And yes, the crime/murder issues are WAY more important, I don't think anyone said they weren't.

I cannot believe the audacity of this council person to believe that his view and his views alone are the voice of Huntington. His statement "what's next poison ivory?" is such an insult to peoples intelligence. I ask you, does poison ivory grow with reckless abandon?, does it grow 3 feet a day?, does it clog cesspools?, does it ruin black top? does it raise concern on perspective property buyers? does it have to be removed by digging up every little piece and chute, in order that it should not return? did governor Cuomo pass legislation outlawing the sale of poison ivory? Well...none of this is true about poison ivory but it is 100 percent true with regards to bamboo. Perhaps Mr. Cuthbertson is totally clueless? I think not. I think Mr. Cuthbertson is content to be where he is for now and forget the people who put him there and the reason he is there in the first place. Need I remind everyone that pacifism does not work. Please do not stick your head in the sand and hope that the problem goes away Mr. Cuthbertson. I implore you to deal with this issue and show some backbone.

If you want revenge on your neighbor plant bamboo! It ruins your garden and it decreases the value of your property if a prospective buyer realizes you have it! I would never wish bamboo on anyone even an enemy!

Once you have an idea, of where he is, you can use a have a heart trap to catch him, if he won't come to you. Some cats get so scared when they get out, that they don't recognize their humans. We have had cats disappear for months, before trapping them.
