Board Approves East 24th Street Requests

Only three new applications were presented to the board, while two tabled matters were also granted.

The Huntington Zoning Board of Appeals approved two applications that were at their May 5 meeting.

An application from Competition Realty for a special use permit, depth extension and parking relief for a Mercedes-Benz dealership located at 1101 Jericho Turnpike in Huntington (ZBA #20242) was granted as presented, while two applications from Peter Morris Construction (ZBA #20230 and ZBA #20231) seeking to construct a home on a lot at 49 East 24th Street while maintaining another dwelling on an adjacent lot were granted with several conditions.

The conditions placed on the Peter Morris Construction application were typical conditions imposed by the board on similar applications. The conditions, referred to as the "Greenlawn Center conditions," prohibited the proposed house from being constructed as a high ranch. They also required the proposed home to be constructed as a single-family dwelling.

There were only three applications presented by the board at the meeting. Application #20235, which sought to regrade the rear yard intruding into a setback of 25 Tiana Place in Dix Hills, was granted as presented by the board. Counsel James Joseph told the board that the regrading of the land was intended to allow the construction of a play area for a child in the home's backyard.

Also approved by the board was Application #20234, which was filed by the Oaxaca Mexican food shop at 385 New York Ave. They were seeking a special use permit to convert its existing food shop to a restaurant in order to up its designated municipal lot parking spaces 10 to 31 spaces. The restaurant seats 32 customers.

One other application (ZBA #20237), filed by the owner of 7 Bayberry Lane, was adjourned by the board so that they could send an inspector to investigate the property. The owner, Ross Meurer, was seeking to legalize multiple structures on the property, including two sheds, a rear cellar entrance, a reconstructed floor, and a rebuilt roof. Meurer said he rebuilt the roof and floor out of necessity (getting a permit to rebuild the floor), but got carried away and constructed the other structures himself with the help of a friend.

In particular, the rear cellar entrance, which was converted from a half-door to a full door, came under fire from the board, who said they've never legalized such a structure in their history. Meurer, who said that the cellar houses a furnace and a work shed, added that he constructed the full door for easier access and that he cannot access the cellar from his house.

The board also approved a parking plan for a two-story hardship apartment located at 25 West Street in Northport. The hardship application was .

The Town of Huntington Zoning Board of Appeals meets every Thursday at 6 p.m. The next meeting will be May 12.
