Father of Capsize Victim Sues

Lawsuit names 10 defendants in boat accident that killed 3 children.

The father of a girl who died when a boat capsized last year filed a negligence lawsuit Friday.

Newsday said that Paul Gaines, whose daughter, Victoria, was one of three children who died, is suing 10 defendants. They were among the 27 people when the boat the Kandi Won, sank in Oyster Bay harbor after a Fourth of July fireworks show. Lisa Gaines, who was on the boat with her children, is not a part of the suit.

Attorney Michael Della of Ronkonkoma filed the suit in Riverhead State Supreme Court, seeking $50,000 from 10 defendants.

Among the defendants, Newsday said, are:

Boat owner Kevin Treanor and brother-in-law, Salvatore Aureliano, who Nassau authorities say was steering the Kandi Won when the boat capsized while trying to return to Huntington after the show.

the boat's manufacturer Silverton Marine Corp.;  two other companies involved in building the boat, Luhrs Marine Group and Morgan Industries Corp.; Guy Denigris, who steered the boat from Huntington to Oyster Bay; Greg and Deborah Aureliano, who escaped from the cabin where the three children drowned; and Cablevision CEO James Dolan and his wife, Kristin. The Dolans had sponsored the fireworks show for several years at its estate in Cove Neck.

Victoria Gaines, who was 7, lived in Huntington. Harlie Treanor, 11, was from Huntington Station, and David Aureliano, 12, Salvatore Aureliano's nephew, was from Kings Park.
